Jakarta (ANTARA News) - The National Awakening Party (PKB)`s executive board led by Muhaimin Iskandar has filed a lawsuit against former president Abdurrahman Wahid (Gus Dur), Ali Masykur Musa and the extraordinary congress of the pro-Gus Dur PKB in Bogor.
The congress of the pro-Gus Dur PKB from April 30 to May 1, 2008, in Bogor, West Java, was illegitimate and against PKB`s statute, a lawyer from the Democracy Defending Team representing the Muhaimain camp, Firman Wijaya, told reporters here Friday.
According to Article 38 point 1 and Article 40 point 3 of the PKB`s statute, an extraordinary congress is considered legitimate if it is attended by 2/3rd of the number of PKB`s ligitimate provincial and district chapters.
In the Muhaimin camp`s view, the pro-Gus Dur PKB`s congress in Bogor which had elected Gus Dur chairman of the party`s consultative board and Ali Masykur Musa as chairman of the party`s executive board was illegitimate as the congress participants were not from legitimate PKB chapters.
Besides Gus Dur, who is PKB`s chief patron, and Ali Masykur Musa, the Muhaimin camp was also suing Effendy Choirie, Yenny Wahid and Masduki Baidowi.
Another lawyer for the Muhaimin camp, Edi Sutrisno Sidabutar, said the lawsuit against the pro-Gus Dur PKB congress in Bogor was in line with Muhaimin`s previous lawsuit against Gus Dur who had dismissed him as chairman of PKB`s executive board.
"So, as the litigant, Muhaimin should not appear in court as the reason of dismissing him is unclear," Edi said.
The clerk of the South Jakarta District Court, Sobary Ahmad, said he would register the case and then schedule it for trial soon.
"We will soon bring the case to the judge and the trial is expected to be carried out next week," he said.
